Return, Refund and Exchange Policy – Semences Artisanales de la Mer

At Semences Artisanales de la Mer, I take pride in my artisanal seeds, and I want you to be completely satisfied. Here are simple, honest rules adapted to the living nature of seeds. I go a bit further than what the law requires to reassure you, but with reasonable conditions to prevent abuse.

  1. Right of Withdrawal (Consumer Protection Act – Quebec)
    You have 10 days from the date you receive your order to change your mind and return the products, in accordance with Quebec law.


  1. General Return Conditions

    • Seeds must be unopened, in their original intact packaging, with no signs of opening or handling.

    • Opened or planted seeds are neither returned nor refunded (for reasons of hygiene, quality, and traceability – this is standard for all artisanal seed producers).

    • Return shipping costs are your responsibility (except in cases of error on my part).


  1. Special Guarantee on Variety and Germination (Beyond Legal Requirements)
    I personally test my batches and guarantee that the seeds match the variety described and have a germination rate consistent with the indications on the packet and product page. If, after planting, you notice an issue (wrong variety or germination significantly below the indicated rate), I commit to making it right.

    • Extended deadline: 180 days after receipt (because plants take time to grow and reveal their true identity – I know it can take weeks or months to verify).

    • How to proceed: Contact me at info@samdelamer.ca with:

      • Order number.

      • Photos of the plants (or seeds if visible), packaging, and growing conditions (soil, temperature, sowing, etc.).

      • No need to open all packets to check; I trust you, but evidence helps avoid misunderstandings.

    • Solution: Free exchange (I’ll send the correct packet or an equivalent variety) or refund if exchange is impossible. No cost to you.

    • Limits: Germination also depends on your conditions (climate, soil, etc.). If the rate is reasonably close to the indicated one (e.g., 70-80% for a tested 85%), that’s normal – human or environmental error happens. No refund for total non-germination without clear proof of a defect on my part.


  1. In Case of Immediate Error on My Part
    If I sent you:

    • The wrong variety (visible without planting).

    • A damaged or incomplete packet.

    • An incorrect quantity.
      I cover everything within 30 days: full refund or free reshipment, and I reimburse return shipping costs (keep your postal receipt).


  1. Return or Guarantee Procedure

    • Write to me at info@samdelamer.ca within the applicable deadline (10 days for withdrawal, 180 days for variety/germination).

    • Provide your order number, reason, and photos/details if possible.

    • I’ll quickly confirm approval and send instructions (return address if needed).

    • Upon receipt and verification, I’ll process the exchange or refund (via the original payment method).


  1. Legal Conformity Guarantee
    Seeds must match the description and be fit for reasonably expected use (germination according to indicated rates under optimal conditions). The legal guarantee applies despite any contrary clause. However, I cannot be held responsible for non-germination due to growing conditions (soil, climate, sowing, etc.).


  1. Refunds

    • Processed within 10 business days after receiving the return or completing verification.

    • Credited to the original payment method.

    • Initial shipping fees are not refunded (except in cases of error on my part).
